Summary
The present work is concerned with the structure of the Communist military law
courts in Poland in the years
legal bases of the structure of the military law courts in that period; the tasks of the
military law courts; the competence of military law courts and who could be the
accused in them; and the organization structure of military law courts.
Polish military law courts in the years in
basis, as the basis was not formed by legal acts that had the character of statute and
regulations issued on their basis, but first of all by legal acts of lower rank.
The tasks of military law courts in the years
way that had been formerly unknown in the Polish law. They had the character of
propaganda and they were connected with Marxist philosophy. The most important
task military law courts had was to protect the Communist system, that is to carry
on struggle against all sorts of class enemies . It was openly stated that the struggle
should lead to physical liquidation and extermination of enemies of the
Communist system.
The next issue discussed in the present work is the state of being accused in a
military court and the competence of those courts. The issue is concerned first of all
with who could be tried by military courts. It turns out that the regulations
concerning this question were constructed in such a way that practically the
perpetrator of any act could be tried by military courts.
The structure of military law courts in the years
characterized by the fact that it only had one instance (until December
appeal model that was in force from
imperfect, as it violated the rule of equality of the parties in court proceedings and
the rule of contradictoriness. Structural chaos of the military jurisdiction could be
clearly seen as e.g. in
competence. Formation at the beginning of
of district military law courts was especially important for the structure of military
jurisdiction. The new law courts took over most cases dealing with the so-called
political crimes.
The result of studies of the remaining issues connected with the structure of
military law courts in Poland in the years
concerning military judges, independence of the judiciary, extra-substantive
supervision, judicial composition in the military law courts and military counsels,
will soon be published in the form of a separate publication.

Summary
The present work is concerned with the structure of the Communist military law
courts in Poland in the years
