t. Institutions are not ends but means. Politics are sub¬
ordinate to Ethics. 2. This was clearly recognised by the
Utilitarians in insisting on the impartial application of the
Greatest Happiness principle. 3. They erred in identi¬
fying happiness with pleasure and in the analysis of motive.
4. The good as a harmony of Experience with Feeling.
5. Harmony as opposed both to anarchy and repression.
6. Harmony of attainment as the object of rational
endeavour.
Chapter II. RIGHTS AND DUTIES 28
1. On the principle of Harmony the Common Good cannot
be opposed to the good of individuals, 2. nor the rights of
individuals set up against the Common Good as the doctrine
of Natural Rights implied. 3. A right imposes duties and
•s one term of a moral relation. 4. It is not a condition
precedent to social welfare but an element in social welfare.
5. Prima facie conflict of rights. The test of operative
consistency and the method of synthesis. 6. Illustrated by
the case of Nationality.

t. Freedom as self determination in the absence of external
constraint has an application beyond the life of man.
2. Internally the life of a man is free as far as it is har¬
monious. 3. Freedom of the will in the sense of indeter
mination is not ethically tenable. 4. But implies deter¬
mination by the outcome of action, 5. and is not affected
by the superficial externality of interests.

1. Freedom within a community involves restraints, 2. in
the form of a system of rights each of which is a liberty.
3. But what is the relation between liberties and liberty ?
4. liberty rests on the spiritual character of personal and
social development, 5. and the protection of rights
( liberties ) on the incompatibility in practice of opposed
lines of conduct. In general no restraint is justified where
no right is invaded. 6. The extension and more complete
definition of rights implies a better system of liberties.
7. This holds even of the extension of public rights so far as
the State acts honestly and intelligently. 8. For Liberty
is the ground of Rights as such and as the central condition
of development is a leading consideration in the definition of
any given right. 9. Tutelage of the immature and infirm
mind is a duty, which must not be so interpreted as to
impair the general principle of self regulation. 10. Political
liberty is no adequate guarantee of personal freedom, but
tends to secure government by the will prevalent in a com¬
munity and thus to substitute the appeal to the will for
force. 11. Liberty in general as the replacement of Force by
Will is both the effect and cause of social harmony. 12. The
historic development of Liberty and its present danger.
Chapter V. JUSTICE AND EQUALITY 94
1. Equality, as an arguable principle of social organization,
means absolute equality in some fundamental rights, or
2. equal proportion of rights to desert, or 3. to needs.
4. These principles agree in founding the rights of the indi¬
vidual on personality. 5. The equality of law consists in the
universality of some fundamental rules and the impartial
application of all rules. 6. Justice involves an equal claim
on the common good in respect of equal needs, 7. subject
to the adequate maintenance of necessary functions. 8. Neither
the development of one class at the expense of another,
nor of the community at the expense of the individual can
be justified by the principle of Harmony. 9. The historical
conflict between equality and inequality. 10. Approxi¬
mations to equality under physical limitations.

1. Responsibility as the natural discipline of the will 2. en¬
forced by Retributive Justice which is founded on the
harmonization of personal and common interests. 3. This
does not admit of the infliction of any evil for its own sake.

1. Exchange at equal market values is just only if values
are determined on just principles. 2. These involve the •
direction of the general economy to the provision of needs in
proportion to their urgency, 3. the non existence of function
less wealth, 4. the remuneration of all work required by
the industrial system on terms adequate to maintain the
worker s civic efficiency, 5. and additional remuneration in
proportion to increased vital costs. 6. As long as the interest
of the individual or the community are not fully harmonized
by other methods remuneration should also increase in ac¬
cordance with the social value of his work, 7. in such wise that
every field of work is on the whole equally attractive to
ability. 8. On this basis an economy resting on free exchange
is ethically desirable.

1. Property as the exclusive right of control. 2. The attri¬
butes of property as such to be distinguished from those
peculiar to private property. 3. Property as the basis of
freedom 4. and of power. 5. The assignment of property
should be so conceived as to secure freedom for the individual
and power for the community.

1. The claims of the community on wealth may be based on
the performance of function, 2. or on the absence of just
claims on the part of any member. The position of inherited

1. When illegitimate elements of profit are excluded the
direction of industry may sometimes be best conducted by
private enterprise. 2. Alternative methods of social control,
by the State (or municipality), the Guild, or the co operation
of consumers. 3. Whatever the executive direction the
control of conditions of work must lie with an impartial body.
Chapter XI. DEMOCRACY . . tS5
1. The problem of democracy is how to secure any effective
expression of will from the ordinary man. ?. Majority rule
is a necessary evil, tolerable as long as there is a real sense
of community, 3. but not when there are deep divisions as
those of nationality. 4. The difficulties are accentuated
by conceptions of Sovereignty. 5. Which is, further, incom¬
patible with the ultimate unity of the human race. 6. The
functional theory of society valuable as suggesting cross
divisions transcending territorial borders, 7. subject to final
co ordination under a world league. 8. The final authority
not legal but spiritual.
