Zusammenfassung: | To what extent is the language of judicial opinions responsive to the political and social context in which constitutional courts operate? Courts are reason-giving institutions, with argumentation playing a central role in constitutional adjudication. However, a cursory look at just a handful of constitutional systems suggests important differences in the practices of constitutional judges, whether in matters of form, style, or language. Focusing on independently-verified leading cases globally, a combination of qualitative and quantitative analysis offers the most comprehensive and systematic account of constitutional reasoning to date. This analysis is supported by the examination of eighteen legal systems around the world including the European Court of Human Rights and the European Court of Justice. Universally common aspects of constitutional reasoning are identified in this book, and contributors also examine whether common law countries differ to civil law countries in this respect |

Universally common aspects of constitutional reasoning are identified in this book, and contributors also examine whether common law countries differ to civil law countries in this respect Verfassungsrecht Constitutional law Constitutional courts Rechtsvergleich (DE-588)4115712-6 gnd rswk-swf Internationaler Vergleich (DE-588)4120509-1 gnd rswk-swf Verfassungslehre (DE-588)4128041-6 gnd rswk-swf Rechtsprechung (DE-588)4115710-2 gnd rswk-swf Verfassungsgerichtsbarkeit (DE-588)4062793-7 gnd rswk-swf Methode (DE-588)4038971-6 gnd rswk-swf 1\p (DE-588)4143413-4 Aufsatzsammlung gnd-content Verfassungsgerichtsbarkeit (DE-588)4062793-7 s Rechtsvergleich (DE-588)4115712-6 s Rechtsprechung (DE-588)4115710-2 s DE-604 Verfassungslehre (DE-588)4128041-6 s Internationaler Vergleich (DE-588)4120509-1 s Methode (DE-588)4038971-6 s 2\p DE-604 Jakab, András 1978- (DE-588)1044031506 edt Dyèvre, Arthur (DE-588)1130617149 edt Itzcovich, Giulio 1975- (DE-588)1142142922 edt Erscheint auch als Druck-Ausgabe, hardback 9781107085589 Erscheint auch als Druck-Ausgabe, paperback 9781107449763 https://doi.org/10.1017/9781316084281 Verlag URL des Erstveröffentlichers Volltext 1\p cgwrk 20201028 DE-101 https://d-nb.info/provenance/plan#cgwrk 2\p cgwrk 20201028 DE-101 https://d-nb.info/provenance/plan#cgwrk |
