Zusammenfassung: | Why do international criminal tribunals write histories of the origins and causes of armed conflicts? Richard Ashby Wilson conducted research with judges, prosecutors, defense attorneys and expert witnesses in three international criminal tribunals to understand how law and history are combined in the courtroom. Historical testimony is now an integral part of international trials, with prosecutors and defense teams using background testimony to pursue decidedly legal objectives. In the Slobodan Milošević trial, the prosecution sought to demonstrate special intent to commit genocide by reference to a long-standing animus, nurtured within a nationalist mindset. For their part, the defense called historical witnesses to undermine charges of superior responsibility, and to mitigate the sentence by representing crimes as reprisals. Although legal ways of knowing are distinct from those of history, the two are effectively combined in international trials in a way that challenges us to rethink the relationship between law and history |

Conclusion: new directions in international criminal trials Why do international criminal tribunals write histories of the origins and causes of armed conflicts? Although legal ways of knowing are distinct from those of history, the two are effectively combined in international trials in a way that challenges us to rethink the relationship between law and history Internationaler Strafgerichtshof (DE-588)3042935-3 gnd rswk-swf Internationaler Strafgerichtshof für Ruanda (DE-588)5282544-9 gnd rswk-swf Internationaler Strafgerichtshof für das Ehemalige Jugoslawien (DE-588)4383997-6 gnd rswk-swf Geschichte 1990-2010 gnd rswk-swf Geschichte Crimes against humanity War crimes Prosecution Evidence, Documentary Political violence / History Civil war / History War / History Verbrechen gegen die Menschlichkeit (DE-588)4124385-7 gnd rswk-swf Internationale Strafgerichtsbarkeit (DE-588)4542351-9 gnd rswk-swf Geschichtsschreibung (DE-588)4020531-9 gnd rswk-swf Völkerrechtliches Verbrechen (DE-588)4204241-0 gnd rswk-swf Strafverfolgung (DE-588)4057803-3 gnd rswk-swf Rechtsanwendung (DE-588)4048765-9 gnd rswk-swf Kriegsverbrechen (DE-588)4033151-9 gnd rswk-swf Internationale Strafgerichtsbarkeit (DE-588)4542351-9 s Kriegsverbrechen (DE-588)4033151-9 s Verbrechen gegen die Menschlichkeit (DE-588)4124385-7 s Strafverfolgung (DE-588)4057803-3 s Rechtsanwendung (DE-588)4048765-9 s Geschichtsschreibung (DE-588)4020531-9 s 1\p DE-604 Internationaler Strafgerichtshof für Ruanda (DE-588)5282544-9 b Internationaler Strafgerichtshof für das Ehemalige Jugoslawien (DE-588)4383997-6 b Internationaler Strafgerichtshof (DE-588)3042935-3 b Geschichte 1990-2010 z 2\p DE-604 Völkerrechtliches Verbrechen (DE-588)4204241-0 s 3\p DE-604 Erscheint auch als Druckausgabe 978-0-521-13831-4 Erscheint auch als Druckausgabe 978-0-521-19885-1 https://doi.org/10.1017/CBO9780511973505 Verlag URL des Erstveröffentlichers Volltext 1\p cgwrk 20201028 DE-101 https://d-nb.info/provenance/plan#cgwrk 2\p cgwrk 20201028 DE-101 https://d-nb.info/provenance/plan#cgwrk 3\p cgwrk 20201028 DE-101 https://d-nb.info/provenance/plan#cgwrk |
