A Historical Survey on Judicial Inquest,
Administring Justice and Law among the
Nobility in the Late Middle Age
The Middle Ages individual had many possibilities for elimi¬
nating various conflicts. As a rule the Church authorities of vari¬
ous degrees would solve problems concerning church rights. The
clergy and the laics were could settle agreements without help
or the dispute was solved by arbiters. They did not depend on
the land law, which was strong in the 13th century, but on indi¬
vidual qualifications of the negotiators. To the beginning of

century the present Slovene territory already had a legal and ju¬
dicial system for the nobility, based on Church (disputes between
nobility and clergy in secular matters), Vassal (concerning feuds),
land (primarily property), provincial courts (for appeals) and
formally personal judicial decisions of the (land) province prince.
All the various forms intercalled in every-day life of the nobil¬
ity. Thus the basic form in a certain case is sometimes hard to
establish. Disputes among clergy and nobility were eaiser solv¬
able on local grounds than before distanced official instances.
Thus in allowed cases the clergy prefered the local
non

institu¬
tional possibilities than the official Church (distanced) jurisdic-
tional instances. Obligatory apperance before the land-prince and
his court did not exist in practice. The question of competence
was secondary.
The capability of the province or State to bring to effect a court
order was small and never reached common consent. Thus in
West-European as well as in Slovene Late Middle Ages

For the court procedure or the instance as the legal subject it was
of essential meaning to protect the right of the first instance ,
which defined the beginning of a court proceeding and at the
same time provided guarantee to the Church and the land-prince
with the privilege ius

and the King could not became a judicial instance for them and
their serfs already at the first degree. In courts for equal social
cathegories of the population the presonal principle was in prac¬
tice (e.g. the province court was competent for the nobility); and
partly the domicile principle for common judging by provincial
law (e.g. position of a disputable property). Up to the middle of
the 13th century the majority of special laws which regulated the
legal frame of judging

regardless of the place of adwelling
-
lost their signification (e.g. tribal law from the Early Middle Ages,
partly ministerial law). Special laws which preserved in action
were those e.g. for towns, Jews and of course the clergy. For the
non-privileged classes, particulary non-free peasant population,
special customs in civil law were kept. From then on it was for a
disputable land tenure

the province it layed in, decisive, not
where the complainant or the accused were from. Within a prov¬
ince the gentleman made in independent decisions where to
charge in order to achieve success the easiest way. From the

which was transitional in all aspects

to the middle of
the 14th century a system was formed which subordinated the
province nobility and their property to the province court; for
the land prince tenure to the
vicedome,
court organs in Vienna
or to the land prince himself; for the non-privileged to patrimonial
(serfs), town or bourgh (townspeople), Jewish (Jews) for severe
offences, while the nobility at the latter never appeared.

The present work should be easy to use. The survey of general
rules of judging, judicial proceedings and customs is followed
by examples of individual basic judicial manners: church courts
on all degrees (from official) to the last Court of Appeal

Synthetic generalisation of judiciary is because of various
diferent
manners pointless not according to the sense, thus there is no
conclusion.
