he seventh edition of this bestselling Irish Law book will bring the reader fully
up-to-date with developments in Irish contract law since publication of the
previous edition in late
2008.
Developments in Ireland are fully covered up until
the end of June
2013.
In addition, Professor Clark has been concerned to take account of
a significant volume of case law generated in Northern Ireland in that five-year-period.
Important developments on the public law and contract law interface, promissory and
proprietary estoppel, mistake and contract formation are fully treated. As in previous
editions the author has been anxious to integrate the more significant judicial decisions
from the courts in England and Wales, Canada, Australia and New Zealand, providing
readers with a comparative law analysis on contract law as it has developed in much of
the common law world. Recent cases on contract formation, particularly uncertainty of
terms and legal intent, express terms, mistake and misrepresentation, duress and
equitable intervention, public policy and restraint of trade are examined for this purpose
and the remedies chapters are expanded significantly.
Professor Clark highlights significant policy shifts and developments in areas of the
law that are not themselves central to the law of contract; in particular, he selects recent
cases dealing with Judicial Review, the estoppels and legitimate expectation on the basis
that recent developments will be likely to trigger a large volume of litigation in the
coming years. The author also takes fuil account of Lord Hoffmann s views on
contractual interpretation, implied terms and the approach to be taken in contractual
mistake, observations that have already been influential in the Irish courts. Legislative
changes, both tangible {e.g. the
2009
land legislation and the Consumer Rights Directive
<2O11)) and proposed (e.g. Law Reform Commission proposals on insurance Contract law
<2O11)) are also noted. Each of the twenty chapters of this text has been expanded to
provide a full and accessible account of this important part of the legal curriculum.
