The study Government in legislative procedure in Poland is an attempt
to present the impact of the government on legislative proceedings in Poland.
The Council of Ministers is a body which occupies a central place in the
system of public authorities in the country and undertakes activities aimed at
developing general policy, and ensuring their implementation through legal
instruments. The government, on which rests the primary responsibility for
the fullfilment of social needs, outlines development prospects.
In a parliamentary system of government, the Council of Ministers has
the public credibility as a body of representation character, which gets poli¬
tical legitimacy to act, through universal suffrage, from the sovereign. The
parliament s political reliance gives a framework for the government actions.
At the same time it is controlled by the parliament. The subject of the work
is the government s influence on legislative proceedings in Poland, i.e. the
achievement of specific and intended effects convergent with the operator s
intentions. The dissertation includes the impact of the Council of Ministers
on the preparation of a bill, on its power to initiate legislative procedure,
then influence the shape of the bill in the
Sejm
and Senate, and influence
the legislative procedure in its final stage.
The purpose of this study was to present the powers of the Council of
Ministers in the context of its impact on the legislative procedure in Poland.
The most important state institutions (the Council of Ministers, the
Sejm
and
Senate, the President of the Republic of Poland, the Constitutional Court)
are involved in the legislative process, which is the primary function of the
parliament. The aim of the study was also to show the solutions of the Polish
constitutional system in the necessary comparative law perspective. Polish legi¬
slative institutions differ from the model constitutional standards. The Polish
model provides both members of the executive with the right of legislative

initiative which is a specific feature of this model. Moreover, the legislative
veto is the President s prerogative.
The analysis of the impact of the Council of Ministers on the legislative
process was based on the criterion of chronology of legislative proceedings,
hence the work was divided into four chapters.
Chapter I entitled System conditions of the legislative activity of the
government presents the conditions of governance, which include among
others: the position of the government in the system and its relations with
other bodies of state authority, the composition and structure of the Council
of Ministers, the tasks, powers and functions of the government and consti¬
tutional conditions of the creation and the responsibility of the government.
The second chapter of the work Government legislative initiative presents
the initiation of legislative proceedings by the government, the analysis of
government bills, and, in particular, their intensity and structure. The paper
also discusses such issues as the government s decision-making system in the
preparation of the bill, the organization of the Council of Ministers or the
mode of operation of the Council of Ministers during the preparation of
the bill. The third chapter entitled The participation of government in the
parliamentary legislative procedure discusses not only the parliamentary
legislative procedure including the consideration of the bill by the
Sejm
and
the position of the Senate towards the laws passed by the
Sejm
but also the
right to amend and the procedure of self amendments. Furthermore, this
chapter debates the problem of representation of the Council of Ministers
during parliamentary legislative proceedings and discusses methods used to
end legislative proceedings, including: the rejection of the bill, the withdra¬
wal of the bill and the expiration of parliament term of office. This chapter
also presents the specific character of legislative proceedings as a matter of
urgency and the effectiveness of government initiatives in practice. The fourth
chapter entitled The final stages of the legislative procedure covers issues
related to the signing of the act by the head of state and the management
of its publication, and possibilities of inhibitory influence on the legislative
procedure, including: the legislative veto and the preventive control of the
constitutionality of laws by the Constitutional Court. This paper is not only
an analysis of normative acts (constitutional, statutory, or regulatory), but
also an analysis of solutions passing for typical, which are the achievements
of constitutionalism.
The influence of the Council of Ministers on the legislative procedure
is of particular importance in a democratic country where the responsibility
is moved to the parliament as a representative body for the public. Unlike

beforel989, the parliament is not just a place where legislative decisions taken
by other institutions are formally approved. After political changes initiated
by the Round Table talks took place in Poland, and with the adoption of the
Polish Constitution of April
2nd, 1997,
the relationship between the legislative
power and the executive in the legislative procedure took a new shape.
Parliamentary cabinet system, in which the government is formed by the
parliamentary majority, is based on the following logic: a political party seeks the
support of voters by presenting an election program, which will be implemented
in the next parliamentary term. The leader of the parliamentary majority forms
the government, and begins implementing the program, which is the consequence
of the legislative agenda.
In order to ensure effective implementation of the program, the parlia¬
mentary majority must provide conditions for its implementation. This is the
logic of the parliamentary cabinet system, where performance is judged by
voters. In the classic parliamentary and cabinet systems the prime minister
will not only determine the pace and order of their legislative initiatives, but
determine the order of the parliament s work.
It should be emphasized, that the government s program sets the strategic
objectives and from this point of view legislative initiatives constitute a tool
for its implementation.
The government is the main holder of the executive power in a parlia¬
mentary cabinet system of government. The choice of such a system in Poland
was determined by constitutional traditions and the needs arising from the
démocratisation
of the political system. However, it is necessary to ensure
balance between a democratically elected parliament and an effectively ope¬
rating executive. The balance in these relationships, on one hand, prevents
power from being held in the hands of one authority (the executive) and, on
the other hand, has a positive impact on the effective exercise of power and
the achievement of political goals approved by the elections.
The Council of Ministers is the key and particularly predestined authority
in the legislative procedure. This results, in particular, from the government s
responsibility for the state of affairs in the country and for the implementation
of domestic and foreign policy in accordance with the will of the parliamentary
majority formed by democratic elections. The Council of Ministers is thus an
authority not only equipped with constitutionally defined powers, but also
a body particularly legitimised in the parliamentary cabinet system. It plays
the key role of guardian of the most important state issues. The head of
the government, the Prime Minister, is not only the chairman of the board,
but usually the leader of the party which forms the governmental coalition.
