Summary
The research presented here focuses on the evolution of the local government system in Poland
since the end of World War II from the point of view of political science. Tackling this problem
seems relevant as it makes it possible, at least to some extent:
1)
to present changes taking place in Poland s administrative system since the end of
World War II from the local and regional level;
2)
to compare self-government in communist Poland and in the Third Polish Republic;
3)
to assess the functioning of national councils;
4)
to specify the direction that further changes in self-government should take.
The book consists of six chapters. They deal with:
1 )
self-government in Poland in
1944-1950,
primarily the place of self-government in the
new political reality and the changes that took place in its functioning in
1946;
2)
the transformation of self-government in Poland into a sham institution and its loss
of authenticity
—
introduction of uniform bodies of public administration, beginning with
the gminas (municipalities), through poviats (districts) to voivodships (provinces), abolition of
gminas and introduction of gromadas as the basic level of state administration, and reform
of the national council system in
1958;
3)
the national council system after the introduction of the
1972-1975
administrative
reform, including, first of all, restoration of gminas, establishment of one-person executive
bodies, changes in the main territorial division of the country and attempt to merge national
councils and local governments again;
4)
changes in local administration in Poland after
1989,
relations between the central gov¬
ernment and local governments after
1989,
and the
1997
Constitution as a guarantee of the
functioning of self-government;
5) 2nd
stage of the decentralisation of the Polish state after the introduction of self-gov¬
ernment on the district and province level as well as changes that have been taking place in this
respect to this day;
6)
directions of the development of self-government in Poland
—
first of all, direct elec¬
tions of heads of municipalities, and mayors of towns and cities, as well as the position of
government administration in the provinces after the
1998
administrative reform.
The present study into the evolution of the self-government system in Poland since the
end of World War II is an attempt to provide a critical reflection that would facilitate better
understanding of the mechanisms of exercising power on the local and regional level in Poland
from the end of World War II to this day. The author analyses its effects in the form of changes
in legal regulations. He chooses not to analyse the mechanisms behind these changes and the
various practices.

Self-government, as a territorial communal corporation subject to public and civil law, is
the basis of local democracy. Power is exercised by residents
—
as members of a self-gov¬
ernment community
—
either directly or through bodies they have elected. In order for local
governments to be fully independent in performing their tasks on their behalf and their own
responsibility for the benefit of residents, they should:
1)
be subjects of public law and civil law;
2)
be autonomous with regard to central government bodies;
3)
have clear local and regional interests;
4)
have clearly defined powers in various areas of life;
5)
have clearly defined and inviolable sources of income;
6)
have their own property;
7)
have well-educated, competent and well-paid officials.
What is necessary for the tasks to be performed is cooperation of the local residents. It is
up to them who will represent them in the exercise of power. That is why residents of local
communities should be aware of their significance, wisely exercise their rights but also fulfil
their obligations, and fully identify not only with the lowest level of self-government
—
mu¬
nicipalities
—
but also with districts and provinces. What is needed, therefore, is an educated
awareness, both local and regional, as well as an unhindered right to freely elect representatives
of various bodies. This is what was missing first of all in self-government between
1944
and
1989.
When deciding to introduce self-government in
1944,
the new authorities had only their
own interest in mind.
However, there were elements suggesting that national councils were a semblance of self-
government. These elements were: decentralisation and influence local communities had on the
functioning of national councils. The scope of national councils powers and tasks did provide
them with some attributes of self-government, especially given the fact that national councils
took them over intact from the abolished self-government bodies.
Research into this subject has revealed that
1)
the functioning of self-government is possible regardless of the political system cur¬
rently in place;
2)
development of self-governance is facilitated by decentralisation of the state and
dém¬
ocratisation
of socio-political life;
3)
self-government reforms of
1989, 1998
and
2002
have not completed the building of
a self-government system in Poland;
4)
what is thus needed are further reforms to strengthen the self-government system by,
first of all, giving it structural characteristics and increasing its powers with regard to self-
determination;
5)
what is needed is an administrative reform that will create a new internal division of the
country based on genuine regions;
6)
the degree of self-governance on the local and regional level, and in local and regional
communities is the degree accorded by the state, regardless of its political system.
