Roads and crossings from the past to the future
of the Slovak Republic
What path led us to today and what path to follow in the future? Our guide
is a man who himself has undergone a long journey of his life. He used to stand
at various crossings and often sought answers to the uneasy question of "what
next". Actually, he questions us in many parts of this book. He is suggesting
the basic features of his own answers, but he leaves it to us to accept them or to
seek and provide our own answers.
The questions are not easy at all. At their simplicity, they look like fun¬
damental questions and the answers seem to be stabilised by the current ap¬
proaches and definitions. Nevertheless, the answers to these questions are al¬
ways open as to the period (times) and existence. What is democracy, truth,
justice, state, sovereignty, the Constitution, nation or patriotism? What is their
expression today and how are they influenced by the current phenomena such
as globalisation, global recession (crisis), relativity/relativisation of values,
material inventions -physical discoveries etc?
The answers provided by Milan
Čič
are soaked by humanism, by believ¬
ing in human goodness (goodness of man) and by the need of mutual solidar¬
ity. He is constantly returning to these matters but not as the repetition of the
things once mentioned but as the confirmation of the correct understanding
of the question. He is asking the reader the same questions in different parts of
the book and is trying to get him to rethink the answers in respect to that very
text unit and situation. He knows very well, that it is impossible to uphold the
original (the same) answers if there is a change of circumstances. At the same
time, he is not trying to make judgements or to condemn anyone. Tactfully, he
is not using names (some exceptions may occur) and instead of focusing on the
people, he is focusing on the events that were lining our way through history
right to its very peak
-
to the formation of a sovereign state.
The emergence (and situation) of the second Slovak republic in the time of
peace
-
is no less complicated than it was in the case of the first Slovak repub¬
lic. The sovereignty of the first Slovak republic was limited by the circumstanc¬
es of World ,lVar II and that is comparable to the sovereignty of the second
Slovak republic after it joined the European Communities and the European
Union, especially after the Lisbon Treaty entered into force. The sovereignty is

more and more limited and Milan
Čič
warns of the ever-growing competen¬
cies and powers of supranational bodies of the European Union. He address¬
es the political actors to think and act when defining the issues of power be¬
tween the European Union and its member states. The passivity in this respect,
although supposedly paid for by the means and funds of the European Union,
leads to the limitation of national (state) sovereignty. It is not important (rele¬
vant) whether the
transferral
of power takes place in favour of an international
organisation or a composite state. It is only the form, however, what really mat¬
ters is the content and that content puts the European Union into the position
of a "super state", whatever the rhetoric of the Brussels oligo-bureaucracy.
In this regard, the thoughts of Milan
Čič
on the merits and meaning of de¬
mocracy seem even more important. He warns of the "flat-vision" (flattened
vision) of democracy as the means of government by the majority. On contra¬
ry, the decision-making processes in the European Union based on the popu¬
lation of countries (member states) and their territory, could lead to the point
that important issues about the future of Slovakia wiii not be decided by the
national bodies, but by supranational bodies dominated by France or Italy.
"The main aim and idea of democracy is the quality of life of free people" and
that freedom includes the people's right to make free decisions.
The democracy in this sense not only threatens the level of state sovereign¬
ty (of member states) within the European Union, but it may also lower the
meaning of the national political system profiling itself to be an omnipotent
"particracy"
/
"partocracy". Its actual powers can be restored
/
maintained by
the Constitution and by the state with the rule of law built on that Constitu¬
tion, i.e. by a constitution and a state with the rule of law that would guaran¬
tee the basic human rights and freedoms. In fulfilling this, the Constitutional
Court plays an important role. Milan
Čič
has greatly influenced the approach¬
es the Constitutional Court had taken shortly after its formation
,
especially
in relation to and by the acceptance of democratic values. He also points out
the need to broaden the powers of this court being it one of the guarantees
of a state with the rule of law. And one can agree with this. Just like one can
agree with the statement, that the Constitution of the Slovak Republic fulfils
its main aims and that the proper application of those principles set forth by
the Constitution strengthens the position of the Slovak republic among other
democratic countries. There is therefore no reason to revoke (repeal) the cur-

rent constitution and to adopt a new one. The dynamics of changes (in global
context) may bring around new needs that should be reflected in the Constitu¬
tion (implemented into the Constitution), but this may happen by amending
(altering) the current wording of the Constitution. It must be added, that since
1993
Slovakia has not changed its state regime or the form of government and
the changes that occurred within the state establishment (especially In the in¬
ternational perspective), have been properly incorporated into the text of the
Constitution. The stability in favour of the society is expressed also by the sta¬
bility of the Constitution, from which the basic principles are evolved. This
applies especially to those principles that are declared in the Preamble to the
Constitution. According to Milan
Čič,
the Preamble to the Slovak Constitu¬
tion is more than just a solemn introduction to the Constitution which is then
followed by the normative (binding) text, i.e. it has a larger meaning than sim¬
ply being of a symbolic value. It is the connection with the spirit of the Slovaks,
i.e. with the state-forming nation, with its tradition and cultural values, but at
the same time pointing out that the (application of the) national self-recogni¬
tion principle does not exclude the application of the "citizenship" dimension.
The Preamble to the Constitution is not only the basic rule of interpretation to
the clauses of the Constitution, but also of the whole legal system and it is be¬
lieved to be the indicator of our future.
Milan
Čič
is of the opinion that a state with the rule of law is inextricably
linked with the matter of social state (welfare state). Its cultivation is an im¬
portant source of quality of life. The solidarity in democratic societies has al¬
ways been a top priority and the current economic recession has confirmed
this issue. At the same time, Milan
Čič
adds that "most importantly, the eco¬
nomic recession has disclosed the problem of moral decline". This means, that
the solution is not only the strengthening of tasks of the state (the state's role),
but also the need to redefine the current civilization substance. The path that
we should follow is clearly marked by Milan
Čič
who suggests that our direc¬
tion indicator or pointer should be the set of moral and ethical principles. The
respect for such principles and their cultivation is the message of this book
-the book that believes in human goodness (goodness of man).
