SUMMARY
At the time of the Liberation of Bulgaria in
1878
up to the
Union of the Principality of Bulgaria with Eastern Roumelia in
1885
the Bulgarian people, similarly to other nations which had
passed through their "French Revolutions", reached the climax
of their bourgeois revolution, which demonstrated that they
could work for their future independently. The five centuries of
bondage had deprived the Bulgarian people of equal partici¬
pation in the development of Europe. Throughout the Revival
period the Bulgarian people were united by traditions and a
common historical heritage. The ethnic Bulgarian Christian
community that had come to life was formed in the difficult
conditions of a struggle for the unification of the territories of
Moesia, Thrace and Macedonia, spread out in a large area. A
real change of national consciousness took place during the first
seven years of the Third Bulgarian state, from the Liberation to
the Unification of
1885.
The new Bulgarian cultural community
that arose mobilized the national potential. The Bulgarian
people had realized its claim to independence and sovereignty
within the boundaries of its state.
After the liberation in
1878
Bulgaria, in its acute need of
experts, the Governments of the Principality of Bulgaria and
Eastern Roumelia turned to the European states and invited
specialists in a variety of fields to assist in the building up of the
administration of the Bulgarian state. Hundreds of foreigners
from over twenty nationalities
—
Russians, Czechs, Frenchmen,
Germans, Swiss, Italians, Belgians, Serbs, Croatians, etc. came
and assisted influencing the development of state and society.
A cultural agreement was concluded between the Princi¬
pality of Bulgaria and Austro-Hungary. Eastern Roumalia, as
part of the Turkish Empire, could not conclude international

agreements, therefore made requests for assistance, which led to
many Czechs, subjects of Austro-Hungary arriving in the
country.
The presence of Czechs in Bulgarian life has been explained
with the policy of the Austro-Hungarian Empire and the absence
of national independence, or the authority of the rule of the
Habsburg
Monarchy, and this has been noted as the occasion for
the dedication of Czechs in the building up of the

state. This explanation had its justification, however and placed
all Czechs, who had voluntarily come to the country, under a
common denominator. The question whether Bulgarian Czechs,
who emigrated from Austro-Hungary, and had settled in the free
state of Bulgaria, or were foreigners temporarily here, under a
contract may have many objective and impartial aspects, but the
answer is by no means indifferent. Because seen from the point of
view of the life of every single one, they could appear in the
periphery of the motivation of a sincere compassion towards the
fate of their Slav brothers, which can sometime be difficult to
understand.
The Czech jurists
Frantisele Hitil,
Rudolf Turn-Taxis, Anton
Bernkopf,
Karel Svoboda,
Hinek Mayer, Innocens
Mraček
all
worked within the judiciary of the Principality of Bulgaria and
Eastern Roumelia. The jurists Rudolf Turn-Taxis and Anton
Bernkopf
to whom this study is devoted, made a substantial
contribution to the development of Bulgarian jurisprudence. The
presentation of episodes of the life of Rudolf Turn-Taxis and
Anton
Bernkopf
aims to enrich the picture of known facts in
Bulgarian history. The reconstruction of events brings out the
details, thus providing completeness and filling this major
historical act, the Unification of the Principality of Bulgaria with
Eastern Roumelia, with meaning.
The study consists of twelve chapters.
Chapter One "The melodies of the European Concert during
the 19th Century" traces the political development of Europe and
especially, the attitudes of the Great Powers to Ottoman Turkey
and the liberation of the Bulgarian lands from centuries of
oppression. After the Berlin Congress decided to create two
Bulgarian states, the Principality of Bulgaria and the autono-

mous
region
of Eastern Roumelia, the development of Bulgarian
society faced serious difficulties. After the Liberation in
1878
the
Russian Military and Civil administration laid the foundations of
Bulgarian institutions. The Czech specialists who arrived in
Bulgaria to work in them took an active part in their
development.
Chapter two "Slavic empathy
—
stronger than nostalgia" is
dedicated to the first wave of Czech specialists who arrived in
Bulgaria, until recently the Balkan province of Orttoman Turkey.
This coincided with the time of the rapid development of Czech
industry in the 19th century, when the possibilities of realization
in Czechia were considerable.
The names of
a pleiade
of Czechs are to be found at various
times in the history of Bulgarian towns and it is difficult to find
one single town in liberated Bulgaria which was not marked by
the Czech presence, where public life ran without Czech
participation. They were among the first founders of new activ¬
ities in Bulgarian life, unknown until then, and with their
knowledge exercised a positive impact on the development of
Bulgarian culture, in the building up of a modern education, on
the development of various branches of industry, and profes¬
sional categories, as well as the public development of the young
Bulgarian state. An emphasis is laid on Czech specialists which
laid the foundation of Bulgarian agricultural education and
agriculture, applying the scientific approach in the their deve¬
lopment. Czechs set the beginnings of the largest brewery in the
Balkans, of the sugar refining industry and foods industries. The
names of Czech artists are among the founders and classics of the
Bulgarian school of Fine art, while in the history of Bulgarian
music many Czech names occur with a major contribution for
the development of music, the creation of wind bands and
symphony orchestras, the production of musical instruments.
Czech specialists were founders in academic and practical
studies in the field of history, geography, archeology, and
museology. They were pioneers in the sciences, mathematics,
physics, chemistry, descriptive geometry. Czechs drew urban
master plans, built bridges, railways, railway stations, industrial
and public buildings, and churches. Decisive for Bulgarian

education and paedagogics were development of short-hand, as
well as for law and the court system. The names of Czech lute-
makers, tuners, photographers, dress designers and tailors, hat
makers, gardeners, printers, cabinet-makers, chemists, engineers
and builders are well known. Czechs also helped in the building
of institutions, passed their administrative experience and activa¬
ted social relations in the young country, giving a qualitatively
different way of life in society. Last but not least Czechs coura¬
geously fought in the battlefields and gave their lives in defence
of the Bulgarian cause and for the honour of Bulgarian flags. For
their contribution to Bulgaria many an eminent Czech has been
awarded the highest Bulgarian medals.
Chater
Three "The Invitation of Czech Jurists to Eastern
Roumenlia" deals with the invitation which the Government of
Eastern Roumelia sent to Czech jurists to take up key positions in
the Court system. The first Director of Justice of Eastern Rou¬
melia was Todor Kesyakov, who approached
Constantin
Jirječek
asking for help so that Dr.
František
L. Riger
could recommend
Czech jurists who could be appointed under him, "to lay the
foundations of the court system and become real apostles of
civilization progress for their Slav brothers". After the Emperors
of Germany, Russia and Austro-Hungary met in
1881
and agreed
on the joint position on the Balkan issue, without going against
the interests of Turkey, the way for the
70 000
army of Austro-
Hungary was open and Austro-Hungary annexed Bosnia and
Herzegovina. Vienna appointed many Czech specialists and
stimulated the creation of a Czech diaspora in the annexed terri¬
tories, however, the presence and activities of Czech specialists in
Bulgaria was not in harmony with her interests. Traced in the
chapter are the intrigues which the Government papers Bohemia
and
Prager Zeitung
created, which Czech jurists had to
overcome. Also given is the role of Dr. Turn-Taxis for the creation
of favourable conditions for the work of the Czech jurists which
had come.
Chapter Four "Czech Fragments and Rudolf Turn-Taxis,
who wanted to turn the world up-side down" follows social and
political events in Czechia during the Revolution of
1848,
up to
Turn-Taxis's departure to Bulgaria. Also traced is the biography

of Prince Rudolf
von
Turn-Taxis, who, led by his ideas of Slav
unity, carried out his commitment towards the Bulgarian
Government.
Chapter Five "Anton
Bernkopf
on the way to his Immig¬
ration" is dedicated to the life of Anton
Bernkopf in
Czechia,
however, the emphasis is above all on his work on the court
system in Eastern Roumelia and the Principality of Bulgaria.
Chapter Six
"Bernkopfs
New Homeland before the Unifi¬
cation" traces the parallel political and social development of
the two Bulgarian states, the Principality of Bulgaria and Eastern
Roumelia.
Chapter Seven "The Iliya Kourtev Affair" decribes the diffi¬
culties before the Principality of Bulgaria and Eastern Roumelia,
after Iliya Kourtev's action, a member of the Bulgarian corps in
the Russo-Turkish War of
1877-1878.
On the occasion of the 9th
anniversary of the death of Hristo Botev, the poet and revolu¬
tionary, he distributed an appeal towards the fighters for freedom
of the people, calling on them to begin a struggle against the
unbearable oppression of the Turks in Macedonia. On orders
from Plovdiv the District Prosecutor of Pazardzhik Hinek Mayer
began an invstigation and Iliya Kourtev was arrested on the
orders of the Examining magistrate Abadzhiev, but after events
took their course in Plovdiv, he was released. Iliya Kourtev's
action is compared to these of
Zaharí Stoyanov
in the Bulgarian
Secret Central Revolutionary Committee (BSCRC) and the
totally contradictory decrees for his arrest and the canceling of
the investigation.
Chapter Eight "Plus royalists
que le roi même"
(More
Royalists than the king himself) is devoted to the culmination of
the Bulgarian Secret Central Revolutionary Committee (BSCRC)
and the preparation of the Unification. The Government of
Eastern Roumelia undertook repressive steps against the suppo¬
rters of the Unification. In the event that the Government scenar¬
io were to be carried out, the outcome of the Unification would be
unpredictable and there would have been a risk for it to be dela¬
yed indefinitely. On the basis of abundant documentary material
an analysis is made of the correspondence between the law
enforcement bodies, the police and the prosecutor's office. The

official authorities wanted to use the prosecutor's office and
subordinate it to their aims. Regional Prosecutor Anton
Bernkopf
took on the risk and responsibility and categoprically rejected the
plans of the authorities. He released Iliya Kourtev and his
accomplices from the prison, refused to arrest
Zaharí Stoyanov
and the other activists of the Bulgarian Secret Central Revolu¬
tionary Committee (BSCRC). As an outcome of
Bernkopfs
action
and stand the Unificationists were not expulsed and continued
their active work to carry out the Unification. However well
planned and co-ordinated with the Porte, the attempt of the East
Roumelian Government's attempt to carry out preventive censo¬
rship over the press failed. The Government realized, that it were
to attempt the closing down of Yuzhna Bulgaria newspaper
(Southern Bulgaria Newspaper)
,
it would become object of sharp
attacks. The authorities had planned, for political reasons, the
Regional Prosecutor was to carry out the dirty job and undertake
the effective closing down of the newspaper, thus the respon¬
sibility for repressive censorship would fall on him. The Regional
Prosecutor did not begin proceedings against Yuzhna Bulgaria,
neither were proceedings begun against the author of the article
attacking the Government, nor the editor-in-chief. Thus Bern-
kopf considerably widened the field of expression not only in
Yuzhna Bulgaria but to the entire opposition press. On the eve of
the Unification Prosecutor Rudolf Turn-Taxis refused to take
action against the opposition
Borba
paper. Regional prosecutor
Anton Bernkopf was reprimanded and moved to
Stara Zagora.
Chapter ten "Two Czech Jurists in the Court System of
Liberated Bulgaria" is devoted to the activities of the jurists
Rudolf Turn-Taxis and Anton Bernkopf, as well as to

Hitil and
Karel Svoboda
in Eastern Roumelia and the Prin¬
cipality of Bulgaria. Rudolph Turn-Taxis' work on legislation
and an academic analysis of Anton
Bernkopfs
Draft Penal
Code, together with their work as prosecutors demonstrate their
real contribution for the consolidation, development and the
introduction of European elements in the Bulgarian court
system.
Chapter Ten "The Anna Simon Case
—
a Projection of Polit¬
ical Passion" shows the principle position of the Appeal Prose-

connection with the murder of the cabaret singer Anna Simon,
which had caused a strong public outcry and was an
international scandal.
Chapter Eleven "The Saviour of the Rose" traces the life of
Konstantine Bernkopf,
Anton
Bernkopfs
son, known for his first
publications on rye, the Razgrad chervenka wheat and the
famous Bulgarian rose.
Konstantine Bernkopfs
contribution to
the sugar refinery in Gorna Oryahovitsa is emphasized. Based on
documentary evidence his service during the First World War in
the 4th Pleven Infantry Regiment and his heroism at Chataldzha
is shown, for which he was given an order for Bravery, for Civil
Services etc.
Chapter Twelve traces the geneaology of the
Bernkopf
family.
