important areas of German law for foreign readers, be they practitioners,
scholars, or students. Each chapter has been written by one or several
experts and presents an overview of the basic structures, concepts, and
rules shaping German law in the respective field. After an initial charac¬
terization of the German legal culture, it covers fourteen specific topics
of private and public law as well as substantive and procedural law. Each
contribution provides a bibliography referring the reader to the most
important literature for more detailed reading.
The book is the successor to the volume published by Werner Ebke and
Matthew Finkin under the same title in
butors to that volume stayed on board, revising and updating their
previous contributions. For a handful of chapters, new authors were
recruited to write entirely original texts.
In the decade that has passed since the original publication, German
law has undergone substantial, and in some areas outright radical, chan¬
ge. This is due mainly to two related factors. First, the impact of
European Union law has become ever more pervasive (if not invasive). It
has not only shaped large parts of consumer and economic law but has
also triggered the most significant reform of the German Civil Code since
its entry into force over a century ago. Second, the German legislature
has generally become more active over the past ten years. Responsive
not only to directives from Brussels but also to the impact of globaliza¬
tion (e.g. on capital markets) and to demands for law reform on the
purely domestic level, German lawmakers have left virtually no area
addressed in this volume untouched and has often revised the respective
law in fundamental ways.
