SUMMARY
The people and the church councils were one of the most important
Serb institutions in the
Habsburg
Monarchy. They were established in the early
18th century in order to elect the head of the Orthodox Church, but in time be¬
came relevant for almost all important issues for Serbs in the Monarchy. In the
second half of the 18th century, some of its jurisdiction was taken over by other
institutions, like the Synod of the Serb Orthodox Church, and it dealt with the
church Issues only. In
1782
the Empress Maria
Theresia (1740-1780)
legally
limited jurisdiction of the council to electing the Archbishop. However, follow¬
ing the
1790
Timişoara
Council, where the discussion about the Serb status
within the Monarchy was reinitiated, this institution regained the important role.
The forerunner of the people and the churche councils was one held in
Belgrade, on the
28 (18)
June
1690.
It was organized by the Serb Patriarch Ar-
senije III Čarnojević
(1672-1706),
during the war between Austria and Turkey
(1683-1699),
during the Austrian army's withdrawal from Serbia, and while
people fled, fearing Turkish reprisals. The council recognized the austrian Em¬
peror Leopold I
( 1658-1705)
as the King of Serbia, and asked him to recognize
the Serb Orthodox Church as a distinctive religious institution in the Monarchy.
The Emperor granted this wish, and through the

1690
Diploma of
Privileges confirmed and recognized certain rights and liberties to the Serb Or¬
thodox Church and to the Serb people within the
Habsburg
Monarchy. The
Diploma also represented the legal basis for the formation of the people and the
church councils, as the Emperor granted Serbs to freely elect their Archbishop.
However, from the Serb point of view, this institution presented the
main place where, besides electing of the Archbishop, all the important issues
for their survival as the ethnic and religious community in the Empire were
discussed. This was clear during the first three councils, called upon for the
election of the Archbishop of the Metropolis of
Karlovci
(in
1708, 1710,
and
1713),
but also discussed other topics. The need for the gatherings apart from
the election appeared quite frequently, so the one in
1714
was organized in
order for the issues of privileges to be debated.
The period between
1718
and
1735
is one of the most important phases
in the development of the institution of the people and the church council. The
debate, as its most important characteristic, came to the fore following the
1716-1718
war against Turkey, in which, among other things, the
Habsburg
Monarchy conquered Serbia and
Banat.
This lasted until the next war
(1737-
1739),
when it lost some of these territories, namely, the ones South of the

rivers
Sava
and Danube. Organizing the newly conquered areas as distinct units
within the Monarchy, that is to say, the establishment of the Kingdom of Serbia
and the
Timişoara Banat,
as well as the foundation of another autonomous Or¬
thodox Archbishoprics for the Serbs in the
Habsburg
Monarchy, the Metropolis
of Belgrade, apart from the already existing one of
Karlovci,
opened a series
of problems, which turned into regular topics for the debates during the coun¬
cils. Among other things, this influenced defining of the jurisdiction of the peo¬
ple and the church councils, as well as the scope of their activities. Eight
councils were held in this time period, with the Emperor's authorization: in
1718
in Dalj,
1721
in Hopovo,
1722
in Petrovaradin,
1726
in
Karlovci,
1730
in Belgrade,
1731
in
Karlovci,
1732
in Belgrade, and in
1735
in
Karlovci
again.
At the same time, there were several so-called unofficial councils, held without
the Empercr's knowledge or permission.
Some of the most important problems discussed in this period con¬
cerned the so-called „issue of privileges." The legal status of the Serb Orthodox
Church and the Serb people in the Monarchy was based on the Privileges.
These were diplomas through which the Emperor Leopold I, between
1690
and
1695,
confirmed and guaranteed certain rights and liberties to the Serb Or¬
thodox Church and the Serb people. Following the expansion of the
Habsburg
rule to Serbia and
Banat,
the question arose on whether the Privileges applied
to these areas as well. Serbs assumed that it was the case, referring to the

Privilege, where the Emperor Leopold I specifically mentioned
Serbia, using the term
Raška,
Rascia,
Beside that, the term
ubi defacto
exìstunt,
used in the Diploma, could refer to any area where Serbs live, regardless on
whether it was at that moment part of the Empire, or whether it would be an¬
nexed to it in the future, as was the case with Serbia and
Banat.
However, the Emperor Charles VI
(1711-1740)
did not agree with this,
and refused to confirm the Privileges for the newly conquered areas of Serbia
and
Banat.
He never issued a special diploma with clearly stated freedoms,
rights, and privileges guaranteed to the Serb Orthodox Church and the popu¬
lation in these areas. In the
1718
Diploma, confirming
Mojsije Petrović
(1.718-
1730)
as the Archbishop and Metropolitan of the new Metropolis of Belgrade,
Charles VI used vague and general expressions, mentioned his archbishop
rights, without specifying them. This offered the state authorities the opportu¬
nity not to respect these rights. The problem escalated in
1724,
when the Met¬
ropolitan Mojsije complained to the Court in Vienna that the authorities do not
respect the Privileges in Serbia. He received the response that these have not
been confirmed for Serbia. In the same year, a secret proposal on how to reduce
the rights of Serbs in Serbia and
Banat
was formulated in Vienna. This proposal
was published for the first time in
1727,
in the form of the Declaration. It served
as an excuse for holding one of the most important unofficial councils, where

delegates agreed that the Privileges issued by the Emperor Leopold I were valid
for all the Serb inhabitants of the
Habsburg
Monarchy. This opinion was con¬
firmed by all the future councils. Serbs' protest influenced the withdrawal of
the Declaration. The struggle of the people and the church councils, delegates,
and metropolitans against attempts of the authorities to narrow the privileges
in part of the land inhabited by Serbs lasted since then. The councils held in
1730, 1732,
and
1735
rejected all attempts by the state authorities to narrow
these rights. This debate was suddenly interrupted by a new war against Turkey
(1737-1739),
and then through a loss of Serbia in
1739.
The „Privileges question" reflected itself upon the right of council to
elect Archbishop of the Serb Orthodox Church in the
Habsburg
Monarchy.
Since
1708,
referring to Privileges, Serbs elected their own head of Church in
the
comicii.
The election was through acclamation
—
by shouting the name of
the chosen man. In the attempt to narrow the Privileges, the Emperor tried to
introduce changes in the election process, through ordering that a council elect
three candidates among the bishops, one of whom he would name as Arch¬
bishop. Essentially, he tried to use on the Serb Orthodox Church the same pro¬
cedure used for the election of bishops in Hungary. In the councils held in the
1726
and
1730,
archbishops were elected, and delegates remained consistent
in the intention to follow the previously established procedure and Privileges,
rejecting any novelties. In this time period, beside electing archbishops, coun¬
cils also chose bishops, especially of the bishoprics that were under great strain
through the expansion of the church union.
The issue of the unification of the Metropolises of
Karlovci
and of
Belgrade was successfully resolved in the people and the church councils be¬
tween
1718
and
1735.
The issue arose in
1718,
when the newly conquered
areas of Serbia and
Banat
were not spiritually joined to the already existing
Metropolis-Archbishopric of
Karlovci,
but a new, Metropolis-Archbishopric
of Belgrade was established. According to the clergy and the people, the divi¬
sion of the Serb people within the two autonomous church regions, represented
an unnatural state of affairs, that had to be rectified. The need for unification
was great, and it was reflected in the debates in the councils. The
1722
election
of the Belgrade Metropolitan

for the co-adjutor, that is to say,
assistant, but also the successor of the
Karlovci
Metropolitan
Vićentije Popović
(1713-1725)
was the first step toward unification. It is important to note that
representatives of the both Metropolises took part, even though they have been
forbidden to hold the joint gathering. The
Karlovci
Metropolis delegates held
their council in Petrovaradin, and, at the same time, the Belgrade Metropolis
delegates held the one in Belgrade. Both councils came up with the same de¬
cision on the election of the co-adjutor, but the Emperor would not confirm it.
The unification of the Metropolis was declared at the
1726
Council, through the

to succeed the
Karlovci
Metropolitan
Vićentije Popović
after his death. The Emperor refused to confirm
this decision, effectively blocking the unification. Despite this, Serbs thought that
the election was beyond any question, and that Mojsije
Petrović
was common
Archbishop and the Metropolitan, and he certainly acted in that way. The official
unification was declared only following the death of the Metropolitan Mojsije.
Even though it was supposed to elect two archbishops, the
1731
Council elected
Vićentije Jovanović
(1731-1737)
as the Metropolitan of Belgrade and
Karlovci,
thus declaring the unification again. The new Metropolitan was confirmed by the
Emperor, under the condition that this situation does not happen again. Thus,
Vićentije Jovanović
was the first and the only one officially recognized joint Bel-
grade-Karlovci Metropolitan. The problem of the two archbishoprics was not
opened following his death in
1737.
The Serb Patriarch Arsenije IV
Jovanović
(1725-1748)
crossed to the
Habsburg
Monarchy. People and clergy immediately
accepted him as their church leader, and the Emperor did not want to open the
issue due to political reasons, as this was the time of war against Turkey
(1737-
1739).
The
1739
Peace Treaty meant that the Monarchy lost Serbia. A great part
of the Belgrade Metropolitan fell under the Ottoman Turkish rule, and was re¬
turned to the jurisdiction of the Serb Patriarchate in
Peć.
In
1741,
Patriarch Ar¬
senije IV was confirmed as the Archbishop of the Metropolis of
Karlovci.
Councils frequently opened debates about the need to establish schools
and fund them, about changes in the way of life and education of clergy and be¬
lievers. Delegates sometimes protested against the changes that metropolitans
wanted to enact, not understanding why they were needed. The
1730
Council
was a turning point in the great support to the Metropolitan Mojsije
Petrović
to enact the changes. This Council's decisions on foundation of schools, the
look and the duties of priests, and behavior of parishioners, were the beginning
of a significant reform activities, also continued by later metropolitans.
The people and the church councils also discussed economic and social
problems of the Serb inhabitants of the
Habsburg
Monarchy. The highest num¬
ber of complaints referred to the abuse of Empire officials and officers during
the tax collection.·The council turned into the institution that represented inter¬
ests of the ordinary people, peasants, and soldiers, and mediated in resolving
their problems with state authorities. They could not solve the problems, but,
through petitions and complaints to the Emperor and the authorities, drew their
attention to the existing problems. For example, a petition from the

Coun¬
cil influenced Emperor Charles VI to decide in
1720
to try to protect the pop¬
ulation from the excessive burden and illegally established taxes. Complaints
from the
1735
Council influenced, and perhaps even accelerated, the declara¬
tion of the
1736
Slavonian
Urbar,
regulating taxes and obligations of the pop¬
ulation towards the state.

Councils also
dealt with financial matters confronted by the Metropolis
of
Karlovci
and Belgrade. They attempted to track the mechanisms for control¬
ling the Metropolis' income and expenses, payment of debts, and cost of the
councils. However, despite all the efforts, they were not very successful in this,
which enabled the Emperor to step in, and in
1737
establish the control over
the finances of Metropolis.
The maintenance and the providing for the Serb Hussar Regiment was
also discussed in the councils. The reached decision were quite important for the
development of the institution of the people and the church councils. Through¬
out the
Habsburg
Monarchy, only the land class had the right to ask for taxes for
the army maintenance. With the Emperor's approval, the
1735
Council decided
that the Serb Hussar Regiment could be additionally financed by taxing the pop¬
ulation. This meant that the Serb people and the Church councils in their juris¬
diction came close to land assemblies in other parts of the Monarchy.
Councils between
1718
and
1735
defined the jurisdiction of this insti¬
tution, and at the same time the rules of their organization. For example, the
rules for selecting delegates were established, as well as regulating the issue of
their accommodation and stay in the place where a council was being held.
The ceremonies to greet and say farewell to the Emperor's representative, to
formally open and close the council, as well as to elect, confirm, and install the
Archbishop, were all established in this period. The councils mastered the art
of communicating with the emperor and the state authorities, and successfully
informed them about the Serbs' problems in the Monarchy. Through the named
commissioners, the councils addressed to the authorities general petitions, com¬
bining all the complaints for not respecting the Privilege rights, state officials'
mishandling, forced taxation, and hard living conditions. They selected mem¬
bers of the delegations, whose task was to inform the influential individuals in
Vienna with the Serbs' problems, thus, through gifts and bribes, occasionally
speeding the solving of these problems.
The experience from the people and the church councils held between
1718
arid
1735
were not sufficiently used in later years. The development of
absolutism in the
Habsburg
Monarchy and the increased influence of the Serb
clergy among the population, influenced the decrease in the importance of the
councils in the following period. Part of the council's jurisdiction was taken
over by the Synod of the Serb Orthodox Church, which was, in the second half
of the 18th century, forced by the
Habsburg
absolutist authorities to make de¬
cisions that would probably never have taken place in the people and the church
councils. After this, the councils were transformed into the institution whose
only task was to elect the Archbishop, except in the situation when a ruler
needed them to include some discussion. |
