Beschreibung: | The purpose of this paper is to present legal framework for individual evaluation of judges in the Republic of Slovenia, criteria used for evaluation, bodies involved in these procedures and their powers and the consequences arising from a particular assessment of the judicial service. The aim of assessing the work of a judge, will be presented within the scope of this article as well. In the Republic of Slovenia, legal basis for the evaluation of judicial performance is set out in the provisions of the Law on the Judicial Service. Further and more detailed description is provided in the implementing act, issued by the High Judicial Council on the basis of the legal authority, i.e. Criteria for the quality of judicial work for the individual evaluation of judicial service. Criteria and measures for the evaluation comprise working skills and professional knowledge, personal characteristics, social and the ability to perform leadership functions. In 2016 the Republic of Slovenia finally abandoned the principle of so-called "judicial norms", according to which a check was made whether the judge solved the prescribed number of cases in the course of a year. In conclusion, the Republic of Slovenia is a state, where a system of formal individual evaluation is applied, wherein the assessment is not based on the scoring principle, but rather on explanation and argumentation of fulfilling each of the prescribed criteria in descriptive form |
