According to its Constitution, Slovenia is governed by the rule of law and is a social state. The state is constitutionally obliged to regulate the fundamental constitutional right to social security, the right to a pension, the right to health care, the social rights of disabled persons, children and families and to organise and supervise the functioning of social insurance schemes. The book is divided into two parts. The first part focuses on questions relating to definitions of the terms social security, social assistance, social advantages and social protection and the characteristics of the schemes they represent. It pinpoints the problems caused by dif¬ ferent interpretations of certain terms at national and international levels. The presentation is based on historical development coupled with international and EU law. The legal aspects of entitlements to benefits in cash and in kind are analysed from the view¬ points of determining who is covered, social security entitlements and various legal relations among legal subjects such as insured persons, employers, social insurance institutes (carri¬ ers) and the providers of benefits, especially those providing health care benefits and other benefits in kind. Lying at the core of the investigation is the social insurance relationship, which is to be distinguished from the private insurance relationship. It not only reflects mu¬ tuality but also various forms of solidarity which are usually absent in private insurance. The part relating to substantive social security law discusses questions of inter-temporal social security law and questions of constraints on the legislative body when regulating social security rights and the rule of proportionality when adjusting pensions and other social security benefits. The role of the Constitutional Court and its rulings concerning the constitutional right to social security are presented. In the part on formal social security law, the organisation and especially the procedures for enforcing social security rights are elaborated. Particular features of the special social 389 Summary ------------------------------------------------------------------------------------------------------ administrative procedure which should guarantee easy access to social rights are empha¬ sised. Specialised labour and social courts have jurisdiction to adjudicate in complaints regarding benefits in cash and in kind lodged against social security institutes and other competent bodies. The section on legal sources gives details of universal, multilateral and bilateral international legal acts binding on Slovenia. Special attention is paid to EU social security law. The EU acquis (including numerous decisions of the Court of Justice of the European Union) mainly co-ordinates the member states social security systems in order to guarantee the free movement of EU citizens. However, it also partially harmonises social security systems either through legally binding (gender equality) or non-binding (via the open method of co-ordination) documents. The role of the Constitution, the legislative acts and autonomous rules of social insurance carriers in the regulation and implementation of social security schemes and individual rights are analysed. In the second part, the different social security schemes existing in Slovenia are examined. Each of them is first placed within a broader legal context, followed by the presentation of a historical overview, general descriptions and the most important comparative features. Individual rights and entitlements regulated in the legislation on pension, invalidity, health and unemployment social insurance schemes, the family benefits scheme and the social as¬ sistance scheme are described. Some open questions and dilemmas concerning the rights and obligations of entitled persons are presented and discussed. It is established that social security law remains closely linked to labour law since workers make up the largest group of socially insured persons. Together, the two laws compose the social law (in a broader context). Nevertheless, social security law has developed in an autonomous legal field. Alongside labour law and perhaps also housing law, it is the field of law which guarantees the existence of the individual (and society). It is his or her faithful companion from birth (or even before it, as concerns benefits for pregnant women), one s entire life (for instance, family benefits or in cases of sickness, invalidity, unemployment, injury at work and old-age) and even after death (regarding benefits to family members of a deceased insured person). Therefore, it is the duty of the legislature, emanating from the state being governed by the rule of law principle, to modify social security law with regular (although not arbitrary and too often) legislative changes to reflect the ever changing social relations. Any book dealing with social security law is bound to be at least partially outdated by the time it is published. Accordingly, after our manuscript was sent to the publisher new legislative changes were publicly debated. A new pension and invalidity insurance act has been presented, a new health insurance act has been announced and a new act on the labour market (including some modifications of unemployment insurance) has been prepared. 390 Due to the reality of social security law always changing, the more general findings hold particular value and may be of assistance to the reader (student, judge or researcher) and the legislature. The latter must always be aware that providing security (including social security) to the inhabitants is and must remain a priority obligation of the state. Shifting the burden of income security when social risks materialise to the individual and his or her family would run against the historically conditioned fundamental values of modern (European) society. International, EU and national, substantive and procedural social security law must be shaped in such a way that its goals can be achieved. It is argued that provisions for appropri¬ ate, not just minimum, protection should be in place when social risks materialise. Poverty and social exclusion have to be prevented or alleviated to enable the free development of individuals and society as a whole. 397
